In the current era, new business formats are rapidly emerging, characterized by the widespread application of Artificial Intelligence (AI). Behind the rapid advancement of AI and other strategic emerging industries, IP plays a key driving role. China is intensifying efforts to strengthen IP protection on AI innovation, with new legal frameworks, faster patent examination processes, and active participation in global governance.
Advocating stronger institutional support
China's AI sector is experiencing strong growth. According to a report released by World Intellectual Property Organization (WIPO), China has become the largest holder of AI-related patents globally, accounting for 60% of the total.
Given the current focus on IP protection in the AI field, China National Intellectual Property Administration (CNIPA) has provided strong institutional support for the development of AI technologies in recent years. For example, CNIPA has revised the Patent Examination Guidelines and formulated the Guide for Patent Applications for Artificial Intelligence-Related Inventions (Trial), actively responding to hot issues and resolving them, such as the eligibility requirements for applicants, scope of protection, and examination standards for AI-related patents.
Accelerating IP protection and application
Earlier this year, the AI model DeepSeek gained widespread global attention. In response to malicious squatting of trademark registrations related to DeepSeek, CNIPA took rapid actions in February, creating a regulated and orderly IP protection environment for the sustainable development of the AI industry.
Over the past year, CNIPA has promoted the application and development of AI technologies by refining relevant policies and deepening the implementation of related initiatives. From patent cultivation to commercialization, from trademark confirmation to IP infringement warning, CNIPA has continuously integrated AI into its work to drive technological innovation and industrial development. For example, the China Intelligent Patent Examination and Search System has been optimized to explore the application of multi-modal large models in patent examination.
Advancing global governance
In 2023, China proposed the Global AI Governance Initiative, upholding a people-centered approach and adhering to the principle of developing AI for good. This initiative has contributed Chinese wisdom to global AI governance.
In terms of IP, China is working with WIPO and many global partners to improve international IP rules and standards on AI. These efforts aim to promote the global development of the AI industry and ensure that AI technologies better benefit all of humanity. Looking ahead, CNIPA will actively promote the co-evolution, mutual empowerment, and integrated development of IP and AI.
